False document was used on my case by the government and, now they are trying to delay and/or obstruct the justice.
References: A. INS Internal Investigation letter dated December 4, 2002, Case number 03X00921 B. A95-605-732/733/734/735 C. Immigration Court New Orleans, LA Order dated March 31, 2003 D. My letter addressed to U.S. Department of Homeland Security Dated April 21, 2003 (Priority Mail Delivery Confirmation Number 0302 1790 0001 9089 9154)
As I explained on my Letter dated April 21, 2003. The Immigration Court, New Orleans, LA has ordered to removal of my two children of four and my wife after 13 years in the United States.
The main evidence that the government submitted to the court (Court exhibit #4) was a letter signed by Thomas L. Fossen, Colonel, USAF, 81st Training Group Commander. The letter says that I was assigned at Keesler AFB From approximately 1995-1997 (Enclosed.)
This information was not true. I was assigned to Keesler AFB, MS between 1990-1992. (Enclosed order.)
I requested Brigadier General Michael W. Peterson, Commander, 81st Training Wing, Keesler AFB, MS., for correction of on previous letter (Court exhibit #4) on April 10, 2003. You and/or your staff can reach his office at 228-377-2010
It is well known by the Government that I should appeal the court decision before May 7, 2003. Otherwise, the court decision would be final.
However, as of April 29, 2003, I have not received any letter from Keesler Air Force Base. I only had a phone call from 81st Training Group. Lt. Colonel Naylor explained me that their files are going back until 1994. (Phone: 228-377-2610)
He could not explain to me how, why and who prepared the letter that was used by the Government if the Group has no information in its file for the dates before 1994. And, How the group came up with the dates of 1995-1997?
I faxed a copy of Special Order MB-62 issued by Department of The Air Force Washington DC 20330-1000 on August 7, 1990 to General Peterson office on April 23, 2003.
It says Major Kemal Ozturk, Turkish Air Force, Embassy of Turkey, 2202 Massachusetts Ave NW, Washington D. C. 20008-2876 is attached-3390 Technical Training Group, Keesler AFB, Mississippi 39534-5000 in TUAF/USAF 2, for duty as an exchange officer effective on or about 15 August 1990. Authority to grant officer access to classified military information is contained in AFR 36-41.(Enclosed)
Today, April 29, 2003, after 7 months of my arrest I received the court exhibit # 11. I reviewed it fist time. It is enclosed. This exhibit clearly explains how and why I was reported to INS. I also enclosed the letter that I did sent a copy of it to then Gov. Ridge on November 29, 2001
I called to General Peterson and talked with his Secretary Ms. Sherry Olesen on April 29, 2003. She told me 81st Training Group has no information about me in their files.
I asked if the group had no files on me who did write the letter that one used as court exhibits #4. Further, the most of the other exhibits submitted to the court were put together with the information provided by the Keesler Air Force Base. If the Keesler Air Force Base has no information about me, how the government provided those exhibits to the court?
I faxed extra 4 pages documents to Lt. Colonel Naylor on April 29, 2003. (Fax: 228-377-3301) Those documents are enclosed.
It is now very clear to me how the Mississippians have team up to penalize my family and me bacause of my letter dated November 29, 2001.
The government agent(s) submitted false evidences to the court to deport my family and me. I have the reason(s) to come up with the following conclusion:
This is a hate crime. The Bureau of Immigration and Customs Enforcement Agent who arrested and hand cuffed me on August 21, 2002 because his friend(s) wanted him to do.
He also abused his official power and used his relationships to get the letter with incorrect dates (1995-1997) on it from his former colleagues.
He made up the case based on that letter. Now, they are trying to do everything possible to delay and/or obstruct the justice by not sending a new letter with the correct dates, on time.
I already have appealed to the court decision on April 21, 2003 without having a letter from Keesler AFB with correct date on it.

However, during the appeal process; A. I do not want to be harassed by the Government Officials, B. I do not want my family and I to be deported for a made up reason(s) C. I would like to make sure my wife and my children are safe.

Lt. Colonel Ozturk returned to Turkey on September 1992. He was assigned as head of security project, to build a new Security System for Turkish Air Force. After reorganization he became first Security Chief of Turkish Air Force.
During his 2 years as Security Chief, designed comprehensive security program for entire Air Force. Opened Security Academy, only the second on the world. Developed 10-year security plan for Air Force, covering Air Force Operations 1995-2005.
He was selected colonel. Because his family was living in U.S.A. he asked his retirement from active duty. He is a reserve officer until September 2008. ................
